Change Note (Nov 18, 2025):
Section 20 (ReVHUES Beauty Program) clarified to state that approved credits are matched to what you paid for eligible VHUES products, capped at up to $30 CAD per approved photo post and up to $50 CAD per approved video post, with a maximum of 2 approvals every 3 months (max $100 CAD) and credits valid for 6 months from issuance. No other changes to your rights or obligations.

Consumer Rights

Nothing in these Terms limits any non-waivable statutory rights that apply to you (for example, rights regarding defective or mis-described goods).

These Terms govern your access to and use of vhues.ca and its related features, tools, programs, and purchasing services (the “Services”).
By using the Services, you agree to these Terms and all incorporated policies.
If you do not agree, please do not use the Services.

If there is a conflict, these Terms control.

1) Eligibility & Acceptable Use

1.1 Age of Majority — You are the age of majority in your jurisdiction, or using the Services under supervision of a parent/guardian who agrees to these Terms.
1.2 Lawful Use — You will not use the Services in violation of any law or regulation.
1.3 Security / Abuse — Do not introduce malware, scrape data, attempt unauthorized access, or disrupt the Services.
1.4 Termination — We may suspend or terminate your access immediately for breach, abuse, or unlawful activity.

2) General Conditions

2.1 We may refuse or cancel orders suspected of fraud, abuse, or resale.
2.2 Services are provided “as available”; uptime and uninterrupted access are not guaranteed.
2.3 Except payment-card data (encrypted by our processor), transmissions may be unencrypted.
2.4 Do not reproduce, resell, or commercially exploit the Services without written consent.

3) Prices, Orders & Changes

3.1 Prices, shipping rates, promotions, free-shipping thresholds, carrier methods, and availability may change without notice. Current shipping thresholds and rates are defined in the Shipping Policy and may vary by region.
3.2 We may correct typographical or pricing errors and cancel or adjust affected orders.
3.3 We may limit quantities per customer or household and refuse orders suspected of resale or redistribution.

4) Products, Display & Claims

4.1 Availability may vary by region.
4.2 Color accuracy depends on device and lighting.
4.3 VHUES BEAUTY products make no medical claims and are not intended to diagnose, treat, or prevent any condition.

5) Billing, Taxes, Currency & Risk of Loss

5.1 Provide complete and accurate billing, payment, and shipping details.
5.2 Duties & VAT (DDU): Prices exclude import duties/VAT unless stated. International orders ship Delivered Duty Unpaid; you are responsible for local duties or clearance fees. Refusal or abandonment voids refunds (see Shipping Policy).
5.3 Currency: Unless shown otherwise, transactions in North America are processed in CAD; all other regions in USD. Your bank may apply FX or transaction fees.
5.4 Risk of Loss: Title and risk transfer once the carrier records an acceptance scan. Claims follow the timelines in the Shipping Policy.

6) 3-SHADE MATCH KIT PROGRAM

6.1 Purpose — Lets customers test three curated foundation shades from the True Match Quiz.
6.2 Fulfillment — Hand-filled in Canada and shipped via standard or Lettermail.
6.3 Final Sale — Custom and hygienic; non-returnable except if defective or damaged on arrival.
6.4 Damage Claims — Report within 7 days with clear photos to support@vhues.ca.
6.5 No Trial Holds — VHUES BEAUTY no longer uses pre-authorization or “try-before-you-buy” billing.

7) Returns & Refunds

7.1 Governed by the Returns & Refunds Policy.
7.2 International Orders — Supported regions (EU, UK, AU/NZ, HK, IL, SG): returns within 14 days if sealed and unused (customer pays postage). Others: final sale except verified defect or carrier damage reported within 7 days.
7.3 Refunds processed within 5–7 business days of receipt; banks may take 5–10 days to post.

8) International Orders

8.1 All international orders ship Delivered Duty Unpaid (DDU). Import duties, VAT, and clearance fees are the responsibility of the recipient and may be billed separately by the carrier. Shipping rates, free-shipping thresholds, and delivery timelines vary by region and are defined in the Shipping Policy. Refusing or abandoning a parcel for unpaid fees voids refund eligibility.

8.2 Currency — Unless stated otherwise, transactions in North America are processed in CAD and all other regions in USD or EUR depending on checkout. Your bank may apply FX or international transaction fees.

9) Subscriptions (Future)

Per the Cancellation & Subscription Policy:
Auto-renew only with clear disclosure and active consent. Cancel anytime via account or email. Renewal reminders and one-click cancellation links provided.

10) Promotions & Pre-Orders

10.1 Promotions are subject to additional terms; not redeemable for cash.
10.2 Pre-Orders — Estimated ship dates are not guaranteed; payment captured per checkout disclosure.

11) User Content (Reviews & UGC)

By submitting, posting, or tagging content (including #vhues or @vhuesbeauty), you grant VHUES BEAUTY a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, adapt, publish, and display it in any media for marketing or operational purposes.
You represent you own the content and that it does not infringe others’ rights or contain personal data without consent.
To request removal of future use, email privacy@vhues.ca with links or screenshots.

12) Electronic & Mobile Communications

Providing your email or phone number = consent to receive transactional updates (orders, shipping, support).
Marketing emails/SMS require explicit opt-in; unsubscribe anytime.

SMS Terms: ≤ 2 messages/month. Reply STOP to unsubscribe; HELP for help. Message/data rates may apply. Consent not a purchase condition. We do not sell or share SMS opt-in data.

13) Disclaimers & Limitations of Liability

13.1 Services and products provided “as is.”
13.2 Maximum liability = amount you paid to VHUES BEAUTY in the preceding 12 months.
13.3 No liability for indirect, incidental, consequential, punitive, or special damages.
13.4 Consumer rights preserved where law forbids waiver.

14) Indemnification

You agree to indemnify and hold harmless VHUES BEAUTY, its officers, employees, partners, and licensors from claims arising from (a) your breach of these Terms, (b) misuse of products, or (c) violation of law or third-party rights.

15) Governing Law & Jurisdiction

Governed by the laws of British Columbia, Canada. Disputes = courts of British Columbia, without limiting non-waivable consumer rights in your region.

16) Miscellaneous

16.1 Force Majeure — We are not liable for delays beyond reasonable control (e.g., natural disasters, government actions, labor disputes, pandemics, carrier or payment-network disruptions).
16.2 Severability — Invalid provisions do not affect the remainder.
16.3 Survival — Price/order, UGC, liability, and governing law sections survive termination.
16.4 Waiver — Failure to enforce = no waiver of future rights.
16.5 Entire Agreement — These Terms + incorporated policies = entire agreement between you and VHUES BEAUTY.

18) Changes

We may update these Terms prospectively. Updates take effect upon posting with a new “Last Updated” date. Continued use = acceptance of revised Terms.

20) ReVHUES Beauty Program

20.1 Overview

The ReVHUES Beauty Program (the “Program”) rewards verified VHUES BEAUTY customers and creators who create and share authentic user-generated content (“UGC”) featuring VHUES products. Participation is voluntary and subject to these Terms, the Program Rules posted on our site, and the Privacy Policy.

20.2 Eligibility

Open to natural persons 18+ (or age of majority in their jurisdiction) who purchased directly through vhues.ca and whose submissions comply with Program guidelines. VHUES may require proof of purchase or verification of authenticity.

20.3 Submissions

Participants may submit UGC (video or photo content) through the official ReVHUES submission form. All submissions must comply with Section 11 (User Content) and Program guidelines. VHUES may disqualify content that violates policy or appears misleading or inauthentic.

20.4 Credits and Value

Approved submissions may earn VHUES store credit equal to the amount you paid for the qualifying VHUES product(s) featured in your post, up to the following caps:

up to $30 CAD in store credit for each approved photo post; and
up to $50 CAD in store credit for each approved video post.

Credit value is based on the product subtotal actually paid for the eligible item(s) in that order (after discounts, before shipping, duties, and taxes).

You may receive up to two (2) approved submissions every three (3) month period, for a maximum of $100 CAD in credits during that period.

Credits:

are issued in CAD as VHUES digital gift cards,
are non-cash, non-transferable, and non-refundable once issued,
are redeemable only toward future purchases at vhues.ca, and
are not convertible to cash or retroactive refunds.

Frequency, eligible products, and additional Program caps or rules are described in the Program Rules and may change prospectively.

20.5 Relation to Refunds or Returns

Participation does not alter or extend rights under the Returns & Refunds Policy or Cancellation & Subscription Policy. If a product used in a ReVHUES submission is later returned, any associated credit will be void and deducted from the refund or cancelled.

20.6 Review and Verification

Submissions undergo authenticity and quality review. VHUES reserves the right to approve, deny, revoke, or modify credits for non-compliance or fraud. Decisions are final.

20.7 License to Use UGC

By submitting content through the Program, you grant VHUES the license rights described in Section 11 (User Content & UGC). Approved content may be used for marketing or promotion without additional notice or payment, subject to law and Program Rules.

20.8 Program Modification, Expiry or Termination

VHUES may suspend, modify, or terminate the Program at any time without notice. Changes apply prospectively and do not affect credits already issued.
Unless stated otherwise in the Program Rules or required by law, unused credits remain subject to their original validity period (currently six (6) months from issuance). After expiry, unused credits may be cancelled.

20.9 No Employment or Agency Relationship

Participation does not create employment, agency, partnership, or sponsorship status with VHUES BEAUTY. Participants act as independent creators and are responsible for any tax obligations arising from credits received.
