Consumer Rights

Nothing in these Terms limits any non-waivable statutory rights that apply to you under applicable law, including rights relating to defective, damaged, or mis-described goods.

These Terms govern your access to and use of vhues.ca and its related features, tools, programs, and purchasing services (the “Services”). By using the Services, you agree to these Terms and all incorporated policies. If you do not agree, do not use the Services.

If there is a conflict between a policy and these Terms, these Terms control, except where a policy states it controls on a specific issue.

1) Eligibility & Acceptable Use

1.1 Age of Majority — You are the age of majority in your jurisdiction, or you use the Services under supervision of a parent/guardian who agrees to these Terms.
1.2 Lawful Use — You will not use the Services in violation of any law or regulation.
1.3 Security / Abuse — Do not introduce malware, scrape data, attempt unauthorized access, or disrupt the Services.
1.4 Termination — We may suspend or terminate access for breach, abuse, or unlawful activity.

2) General Conditions

2.1 We may refuse, cancel, or limit orders suspected of fraud, abuse, or unauthorized resale.
2.2 Services are provided “as available.” Uninterrupted access is not guaranteed.
2.3 Data transmissions may pass through networks and may be altered to conform to technical requirements. Payment data is handled by payment processors.
2.4 You may not reproduce, resell, or commercially exploit the Services without written consent.

3) Prices, Orders & Changes

3.1 Prices, shipping rates, promotions, free-shipping thresholds, delivery options, and availability may change prospectively. Current rates and thresholds are listed in the Shipping Policy and may vary by region.
3.2 We may correct errors (including pricing, descriptions, promotions, or availability) and cancel or adjust affected orders.
3.3 We may limit quantities per customer/household and refuse orders suspected of redistribution.

4) Products, Display & Claims

4.1 Product availability may vary by region.
4.2 Color accuracy depends on device, lighting, and display settings.
4.3 VHUES BEAUTY products do not make medical claims and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

5) Billing, Taxes, Currency & Risk of Loss

5.1 You agree to provide complete and accurate billing, payment, and shipping information.

5.2 International Duties & Taxes (DDU) — Unless stated otherwise, international orders ship Delivered Duties Unpaid (DDU). Import duties, VAT, customs clearance, and brokerage fees are not included and are the responsibility of the recipient. Refused or abandoned shipments due to unpaid fees are not eligible for refund (see Shipping Policy). We reserve the right to cancel and refund orders prior to dispatch if a destination becomes unavailable or undeliverable due to carrier limitations or import restrictions.

5.3 Currency — Checkout currency may vary by region. North America orders are processed in CAD. Other regions may process in USD or EUR depending on checkout settings. Your bank may apply FX or transaction fees.

5.4 Risk of Loss — Risk transfers when the carrier records an acceptance scan, subject to mandatory consumer protection laws. Claims follow the timelines and process in the Shipping Policy.

6) Returns & Refunds

Returns and refunds are governed by the Returns & Refunds — Complete Confidence Policy, which defines eligibility, scope, timelines, and limitations.

7) International Orders

International shipping options, timelines, and region-based thresholds are governed by the Shipping Policy. International orders ship DDU unless stated otherwise. Customs processing and delays are outside our control.

8) Subscriptions (Future)

VHUES BEAUTY does not currently offer subscriptions. If subscriptions are introduced, they will require clear disclosure, affirmative consent, and easy cancellation as described in the Purchase Options, Cancellation & Subscription Policy.

9) Promotions & Pre-Orders

9.1 Promotions are subject to additional terms and are not redeemable for cash unless required by law.
9.2 Pre-orders, if offered, will disclose estimated timelines; estimates are not guarantees.

10) User Content (Reviews & UGC)

10.1 Your Content — If you submit content to us (such as a review, testimonial, photo, video, comment, or other material), you represent that you own or have permission to use it and that it does not infringe third-party rights or include personal information of others without consent.

10.2 License — When you submit content directly to VHUES BEAUTY (including via forms, email, or reviews), you grant VHUES BEAUTY a worldwide, royalty-free, non-exclusive license to use, reproduce, publish, display, and adapt that content for our business purposes, including marketing, subject to applicable law and platform rules. Where required by law or platform policy, we may request additional permission for certain uses (including paid advertising).

10.3 Removal Requests — To request removal of future use of submitted content, email privacy@vhues.ca with links or screenshots. We will make commercially reasonable efforts to honor requests going forward.

11) Electronic & Mobile Communications

Providing your email or phone number allows us to send transactional updates (orders, shipping, support). Marketing messages require explicit opt-in. Unsubscribe anytime.

SMS Terms: Reply STOP to unsubscribe; HELP for assistance. Message/data rates may apply. Consent is not a purchase condition. We do not sell or share SMS opt-in data.

12) Disclaimers & Limitations of Liability

12.1 Services and products are provided “as is” and “as available,” except where prohibited by law.
12.2 To the maximum extent permitted by law, our total liability is limited to the amount you paid to VHUES BEAUTY for the transaction giving rise to the claim.
12.3 We are not liable for indirect, incidental, consequential, punitive, or special damages where permitted by law.
12.4 Mandatory consumer protections are preserved.

13) Indemnification

You agree to indemnify and hold harmless VHUES BEAUTY and its affiliates, officers, employees, and contractors from claims arising from your breach of these Terms, unlawful use of the Services, or violation of third-party rights.

14) Governing Law & Jurisdiction

These Terms are governed by the laws of British Columbia, Canada, without limiting non-waivable consumer rights in your jurisdiction. Disputes will be resolved in the courts of British Columbia, Canada.

15) Miscellaneous

15.1 Force Majeure — We are not liable for delays beyond reasonable control (carrier disruptions, customs delays, labor actions, pandemics, natural disasters, government restrictions, payment-network disruptions).

15.2 Severability — Invalid provisions do not affect the remainder.

15.3 Survival — Sections on user content, disclaimers, liability, indemnification, and governing law survive termination.

15.4 Waiver — Failure to enforce is not a waiver.

15.5 Entire Agreement — These Terms and incorporated policies form the entire agreement.
