TERMS OF SERVICE — VHUES BEAUTY

Consumer Rights

Nothing in these Terms limits, excludes, or overrides any non-waivable statutory right or remedy that applies under applicable law, including rights relating to cancellation, withdrawal, delivery, defective, damaged, incorrect, mis-shipped, unsafe, or mis-described goods.

These Terms govern your access to and use of vhues.ca and its related features, tools, programs, and purchasing services (the “Services”).

By accessing or using the Services, you agree to these Terms and the policies incorporated below, subject to any rights that cannot lawfully be limited or waived.

If you do not agree to these Terms, please do not use the Services.

The following policies apply to the Services and purchases made through vhues.ca:

Each subject-specific policy governs the matters it addresses.

For example:

The Returns & Refunds — Complete Confidence Policy governs return and refund eligibility
The Shipping Policy governs fulfillment, delivery, shipping, customs, and related matters
The Purchase Options, Cancellation & Subscription Policy governs voluntary order cancellations and any future subscription, automatic-renewal, or recurring-purchase services
The Privacy Policy governs the collection, use, disclosure, and handling of personal information

If these Terms conflict with a subject-specific policy on a matter expressly governed by that policy, the subject-specific policy controls for that matter.

If applicable law conflicts with these Terms or an incorporated policy, any mandatory legal requirement controls.

The FAQ and other informational or educational content on the Website are provided for convenience and do not independently modify these Terms or the incorporated policies unless expressly stated.

1) Eligibility & Acceptable Use

1.1 Age and Capacity

You must have the legal capacity to enter into a binding agreement in your jurisdiction.

If you are under the applicable age of majority, you may use the Services only with the involvement and permission of a parent or legal guardian who accepts responsibility for your use of the Services.

1.2 Lawful Use

You may not use the Services for any unlawful, fraudulent, abusive, or unauthorized purpose or in violation of applicable law or regulation.

1.3 Security and Abuse

You may not:

Introduce malware, malicious code, or harmful technology
Attempt unauthorized access to the Website, customer accounts, systems, or data
Interfere with or disrupt the operation or security of the Services
Circumvent technical or security measures
Scrape, harvest, or extract data through unauthorized automated means
Use the Services to impersonate another person or misrepresent your identity

1.4 Suspension or Termination

VHUES BEAUTY may suspend or restrict access to the Services where reasonably necessary to address fraud, abuse, security risks, unlawful activity, or material violations of these Terms.

Nothing in this section limits rights relating to an existing purchase that cannot lawfully be restricted or terminated.

2) General Conditions

2.1 Orders

VHUES BEAUTY may refuse, cancel, or limit an order where there are reasonable grounds to suspect:

Fraud or unauthorized payment activity
Abuse of promotions or policies
Unauthorized commercial resale or redistribution
Material pricing or listing errors
Unlawful activity
An inability to lawfully or reasonably fulfill the order

If VHUES cancels a paid item or order before fulfillment, amounts collected for the cancelled item or order will be refunded as appropriate and as required by applicable law.

Customer-requested voluntary cancellations are governed by the Purchase Options, Cancellation & Subscription Policy.

2.2 Website Availability

The Website and its digital features may occasionally be unavailable due to maintenance, updates, technical failures, security issues, or circumstances beyond our reasonable control.

Continuous or uninterrupted access is not guaranteed.

2.3 Third-Party Services

Certain parts of the Services may depend on third-party providers, including payment processors, ecommerce platforms, carriers, analytics providers, and other technology services.

Their separate terms and privacy practices may apply where appropriate.

2.4 Commercial Use of the Services

Unless expressly authorized in writing, you may not reproduce, resell, commercially exploit, or create unauthorized commercial services based on the Website or Services.

This restriction does not prevent ordinary personal sharing of publicly available VHUES BEAUTY content where otherwise lawful.

3) Prices, Orders & Changes

3.1 Prices and Availability

Prices, shipping rates, promotions, free-shipping thresholds, delivery options, and product availability may vary by region and may change prospectively.

The price, currency, shipping charge, applicable discounts, and other transaction-specific information presented at checkout apply to the order, subject to correction of genuine errors and applicable law.

3.2 Errors and Corrections

VHUES BEAUTY may correct typographical, technical, pricing, promotional, availability, or product-information errors on the Website.

Corrections to Website content may be made prospectively without notice.

If a material error affects an existing order before fulfillment, VHUES may contact the customer before proceeding.

Where the order cannot reasonably be fulfilled on the terms presented because of a material error, VHUES may:

Ask the customer to agree to the corrected information; or
Cancel the affected item or order and issue any required refund

VHUES will not retroactively impose a material price increase or materially different purchase term on an existing order without the customer's agreement where such agreement is required.

Nothing in this section limits rights relating to inaccurate, misleading, or mis-described goods or services under applicable law.

3.3 Quantity Limits and Resale

VHUES BEAUTY may establish reasonable purchase limits and may restrict orders reasonably believed to be intended for unauthorized commercial resale, redistribution, or policy abuse.

4) Products, Display & Claims

4.1 Product Availability

Products, shades, formats, packaging, and availability may vary by region.

Product availability may change without notice before an order is placed.

4.2 Colour and Display

VHUES BEAUTY makes reasonable efforts to represent product colours and appearance accurately.

Actual appearance may vary due to lighting, photography, display settings, screen calibration, device characteristics, skin tone, application method, and other factors.

4.3 Cosmetic Product Information

Unless expressly stated otherwise and lawfully authorized, VHUES BEAUTY cosmetics are not represented as products intended to diagnose, treat, cure, or prevent disease or medical conditions.

Product descriptions, ingredient information, usage guidance, and cosmetic benefit descriptions should be read in the context in which they are presented.

Nothing in this section limits any right relating to a defective, unsafe, incorrect, or mis-described product.

5) Billing, Taxes, Currency & Delivery Risk

5.1 Billing and Order Information

You agree to provide current, complete, and accurate information reasonably necessary to process and deliver your order, including billing, payment, contact, and shipping information.

You are responsible for reviewing order information before completing checkout.

If you discover an error after placing an order, please contact VHUES as soon as possible. Whether an order detail can be changed depends on the status of the applicable order or item.

5.2 International Duties & Taxes

Unless checkout or the applicable Shipping Policy states otherwise, international orders may be shipped Delivered Duties Unpaid (DDU).

Where applicable, import duties, VAT, customs charges, brokerage fees, clearance fees, or similar charges imposed by customs authorities, carriers, or other third parties may be payable by the recipient.

Where VHUES collects duties or taxes at checkout, the terms displayed at checkout will apply.

Customs refusals, unpaid duties or taxes, abandoned shipments, and related circumstances are governed by the Shipping Policy, subject always to applicable consumer law.

VHUES BEAUTY may cancel and refund an order before dispatch if the destination becomes unavailable, restricted, or undeliverable due to carrier, legal, customs, or import limitations.

5.3 Currency

The transaction currency applicable to an order is displayed at checkout before purchase.

Available currencies may vary by region.

A customer's bank, card issuer, payment provider, or other financial institution may independently apply currency-conversion, foreign-exchange, or transaction fees.

5.4 Risk of Loss or Damage

Risk of loss or damage to goods passes in accordance with applicable law.

Nothing in these Terms transfers risk of loss or damage to a consumer earlier than permitted by applicable law.

Shipping, delivery, missing-package, and carrier-related claims are otherwise handled in accordance with the Shipping Policy.

6) Returns & Refunds

Return and refund eligibility is governed by the Returns & Refunds — Complete Confidence Policy.

That Policy establishes applicable:

Product eligibility requirements
Unopened-product requirements
Hygiene and condition standards
Final-sale restrictions
Inspection requirements
Return-shipping responsibilities
Refund methods and timing
International return provisions
European Union statutory withdrawal rights
United Kingdom statutory consumer rights
Damaged, defective, incorrect, mis-shipped, unsafe, and mis-described product procedures

Submitting a voluntary return request does not itself establish that a product qualifies for return.

Where applicable law provides a non-discretionary withdrawal, cancellation, refund, warranty, guarantee, or other consumer right, that right is not made subject to discretionary VHUES approval.

Nothing in this section limits mandatory consumer remedies.

7) International Orders

International shipping availability, estimated timelines, customs responsibilities, delivery terms, and region-specific requirements are governed by the Shipping Policy.

International orders may be subject to import restrictions, customs processing, duties, taxes, brokerage charges, and local requirements beyond VHUES BEAUTY's direct control.

Eligible international returns are governed by the Returns & Refunds — Complete Confidence Policy, including the applicable international return framework, product-eligibility requirements, return-shipping responsibilities, and refund procedures.

Eligible European Union consumers may also have statutory withdrawal rights under applicable European Union and national law.

Eligible United Kingdom consumers may also have statutory cancellation, return, refund, and other consumer rights under applicable United Kingdom law.

Customers in other jurisdictions may similarly have mandatory consumer rights that apply independently of the voluntary VHUES return framework.

Cancellation of unfulfilled international items is governed by the Purchase Options, Cancellation & Subscription Policy.

Nothing in these Terms or the incorporated policies limits mandatory consumer protections applicable in the customer's jurisdiction.

8) Subscriptions & Recurring Purchases

VHUES BEAUTY does not currently offer subscription, automatic-renewal, or recurring-purchase services.

No purchase through vhues.ca will automatically enroll a customer in a subscription unless a subscription or recurring-purchase service is expressly introduced and the customer affirmatively chooses it.

Before any subscription, automatic-renewal, or recurring-purchase service is introduced, VHUES BEAUTY will provide applicable terms and required disclosures concerning matters such as:

Price and billing frequency
Product or delivery frequency
Renewal terms
Cancellation methods
Applicable notices or reminders
Material changes
Refund rights
Other information required by applicable law

Any subscription or recurring-purchase service will be governed by the Purchase Options, Cancellation & Subscription Policy and any additional terms disclosed before enrollment.

9) Promotions & Pre-Orders

9.1 Promotions

Discounts, promotional offers, gifts with purchase, promotional codes, and similar offers may be subject to additional eligibility requirements, dates, exclusions, quantity limits, or other terms disclosed with the promotion.

Promotions have no cash value and are not redeemable for cash except where required by applicable law.

VHUES BEAUTY may refuse or cancel use of a promotion where there is reasonable evidence of fraud, manipulation, unauthorized duplication, or material abuse.

Where a return or cancellation affects an order that received promotional pricing, any adjustment is governed by the applicable promotion terms, incorporated policies, and applicable law.

9.2 Pre-Orders

If pre-orders are offered, the applicable product page or checkout will disclose available estimated fulfillment, availability, or shipment information.

Estimated dates may change due to production, supply, carrier, regulatory, or other circumstances.

Where a delay gives the customer a cancellation, consent, refund, or other right under applicable law, that right remains unaffected.

10) Reviews, Testimonials & User-Generated Content

10.1 Content Covered by This Section

This section applies when you intentionally submit content for publication, review, testimonial, promotional consideration, or other public-facing use, including:

Product reviews
Testimonials
Photos or videos submitted for potential brand use
Social media content submitted to or expressly shared with VHUES for potential use
Comments or other materials intentionally submitted for publication

This section does not automatically apply to private customer-service communications or materials submitted solely to resolve an order, return, refund, complaint, safety concern, or support request.

For example, photos submitted to document a damaged product, skin concern, return condition, or shipping issue are not treated as marketing content merely because they were sent to VHUES BEAUTY.

10.2 Your Rights and Responsibilities

When submitting covered content, you represent that:

You own the content or have the rights and permissions necessary to submit it
Its submission and permitted use do not infringe another person's rights
It does not knowingly contain false or unlawful material
You have obtained appropriate permission before including identifiable third parties or their personal information

10.3 Licence for Submitted Content

When you intentionally submit content for publication, review, testimonial, or promotional use, you grant VHUES BEAUTY a worldwide, royalty-free, non-exclusive licence to reproduce, display, publish, distribute, format, crop, resize, and otherwise adapt that content for VHUES BEAUTY's business and marketing purposes, subject to applicable law and any additional permissions required by a platform or specific use.

VHUES BEAUTY will not intentionally edit a review or testimonial in a way that materially changes the meaning, experience, or opinion expressed by the person who submitted it.

Where additional consent is required for a particular use, including certain paid advertising, creator content, likeness uses, or platform-specific advertising permissions, VHUES BEAUTY may request separate authorization.

10.4 Reviews and Testimonials

Reviews and testimonials may reflect individual experiences and do not necessarily represent results that every customer will experience.

VHUES BEAUTY may moderate content for matters such as:

Unlawful content
Spam
Privacy concerns
Harassment
Irrelevant material
Violations of applicable review-platform rules

VHUES will not knowingly alter legitimate customer sentiment in a manner that materially misrepresents the reviewer's experience.

10.5 Requests Concerning Future Use

To request that VHUES BEAUTY stop future use of submitted marketing content, contact:

Please include sufficient information to identify the applicable content, such as a link, screenshot, or description.

VHUES BEAUTY will make commercially reasonable efforts to discontinue future use where appropriate, subject to rights already granted, completed publications or campaigns, legal obligations, archival requirements, and applicable law.

11) Electronic & Mobile Communications

11.1 Transactional Communications

When you place an order, contact customer support, create an account, submit a request, or otherwise transact with VHUES BEAUTY, we may send communications reasonably necessary to:

Confirm or process an order
Provide shipping or delivery information
Respond to customer-service requests
Provide return, refund, or cancellation information
Communicate security, account, or service-related information
Fulfill legal or contractual obligations

Transactional communications are distinct from optional marketing communications.

11.2 Marketing Communications

VHUES BEAUTY sends marketing emails, SMS messages, or other commercial electronic communications only where permitted by applicable law and subject to applicable consent and disclosure requirements.

Marketing communications will include an appropriate method to unsubscribe where required.

Unsubscribe requests will be processed in accordance with applicable law.

11.3 SMS Communications

If VHUES BEAUTY offers SMS marketing or notification services, applicable terms will be disclosed when the customer enrolls.

Consent to marketing messages is not a condition of purchase

SMS consent and opt-in information will be handled in accordance with the Privacy Policy and applicable law.

12) Disclaimers & Limitations of Liability

12.1 Website and Digital Services

To the maximum extent permitted by law, the Website and its digital functionality are provided on an “as available” basis.

VHUES BEAUTY does not guarantee that every digital feature will always be uninterrupted, error-free, or available.

This provision does not disclaim, waive, or reduce any statutory condition, warranty, guarantee, product-safety obligation, or consumer remedy applicable to goods purchased from VHUES BEAUTY.

12.2 Limitation of Liability

To the maximum extent permitted by applicable law, and except for liability that cannot lawfully be excluded or limited, VHUES BEAUTY's aggregate liability arising from a particular purchase or transaction will not exceed the amount paid to VHUES BEAUTY for the transaction giving rise to the claim.

This limitation does not apply to the extent that applicable law prohibits such a limitation.

12.3 Excluded Damages

To the maximum extent permitted by applicable law, VHUES BEAUTY is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services or a transaction with VHUES BEAUTY.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any liability or statutory remedy that cannot legally be waived, excluded, or restricted.

12.4 Consumer Protections

All mandatory consumer protections, statutory warranties, statutory conditions, product-safety obligations, and remedies that cannot lawfully be waived remain unaffected.

13) Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless VHUES BEAUTY and its officers, employees, contractors, and service providers from third-party claims, losses, or reasonable costs arising directly from:

Your intentional or unlawful misuse of the Services
Fraudulent activity conducted by you through the Services
Content you submit that infringes another person's intellectual-property, privacy, publicity, or other legal rights
Your material violation of applicable law in connection with your use of the Services

This section does not require a consumer to indemnify VHUES BEAUTY for VHUES BEAUTY's own negligence, unlawful conduct, breach of statutory duty, or other liability that cannot lawfully be transferred to the consumer.

14) Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles, except to the extent that mandatory consumer law in another jurisdiction applies and cannot lawfully be excluded.

Nothing in these Terms deprives a consumer of mandatory protections available under the law applicable to them.

Subject to any mandatory right to bring proceedings in another jurisdiction, the courts of British Columbia, Canada have non-exclusive jurisdiction over disputes relating to these Terms or the Services.

Nothing in this section requires a consumer to waive a forum, jurisdiction, tribunal, dispute-resolution process, or remedy that applicable law gives them on a non-waivable basis.

15) Miscellaneous

15.1 Force Majeure

VHUES BEAUTY is not responsible for delays or failures caused by events beyond our reasonable control, including:

Carrier disruptions
Customs delays
Labour actions
Pandemics or public-health emergencies
Natural disasters
Severe weather
Government restrictions
Widespread infrastructure failures
Payment-network disruptions
Other comparable circumstances beyond our reasonable control

Nothing in this section limits any cancellation, refund, delivery, withdrawal, or other consumer right that cannot lawfully be excluded or restricted.

15.2 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or severed to the minimum extent necessary, and the remaining provisions will continue to apply where legally possible.

15.3 Survival

Provisions that by their nature should continue after termination or completion of a transaction will survive as appropriate, including provisions relating to intellectual property, submitted content, limitations of liability, indemnification, governing law, and accrued rights.

15.4 No Waiver

A failure or delay by VHUES BEAUTY to enforce a provision does not constitute a waiver of that provision or any other right.

15.5 Entire Agreement

These Terms, the incorporated policies, transaction-specific checkout disclosures, and applicable order information form the agreement governing your use of the Services and purchases made through vhues.ca, subject to applicable law.

Nothing in this section excludes representations, disclosures, warranties, or other terms that applicable law requires to form part of the consumer contract.

16) Notices

VHUES BEAUTY may provide notices through the Website, by email, through customer-account functionality, or by another reasonable method appropriate to the notice.

Where applicable law requires notice to be delivered individually, in writing, in a durable medium, or by another specified method, VHUES BEAUTY will provide notice in the manner required by law.

17) Changes to These Terms

VHUES BEAUTY may update these Terms prospectively.

Updates will be identified by a revised Last Updated date.

Changes to general Website-use terms apply prospectively from the effective date of the updated Terms.

Terms governing an existing purchase will not be retroactively changed in a way that reduces contractual or statutory rights unless:

The customer expressly agrees to the change; or
Applicable law otherwise permits the change

Where applicable law requires advance notice, consent, or another procedure before a contractual change becomes effective, VHUES BEAUTY will follow that requirement.

Nothing in an updated version of these Terms limits rights that already arose under an existing transaction or applicable law.
